Terms of Service

1. Acceptance of Terms

By accessing or using the True Grit Auto platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including customers and technicians.

2. Description of Service

True Grit Auto is an online marketplace that connects vehicle owners ("Customers") with independent automotive technicians ("Technicians"). We provide the platform and tools to facilitate these connections but are not a party to the service agreements formed between Customers and Technicians.

True Grit Auto does not employ technicians and is not responsible for the quality, safety, legality, or completion of any automotive services arranged through the platform.

3. Account Registration

• You must be at least 18 years old to create an account.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Customer Terms

4.1 Job Postings

Customers may post repair jobs on the platform. Each job posting after the first requires a $5.00 non-refundable posting fee. Job postings must be accurate and in good faith.

4.2 Deposit Requirement

When accepting a technician's application, Customers are required to pay a 50% upfront deposit based on the technician's proposed rate and estimated hours. This deposit covers parts and materials. The remaining 50% balance is due upon completion of the repair.

4.3 Payment Obligation

By accepting a technician's application, Customers commit to paying the agreed rate for services rendered. Failure to pay may result in account suspension, loss of platform access, and potential legal action.

5. Technician Terms

5.1 Subscription

Technicians must maintain an active monthly subscription ($100/month) to apply for jobs on the platform. Subscriptions auto-renew monthly and can be cancelled at any time, taking effect at the end of the current billing period.

5.2 Independent Contractor Status

Technicians are independent contractors, not employees of True Grit Auto. Technicians are solely responsible for their own taxes, insurance, tools, and compliance with applicable laws and regulations.

5.3 Stripe Connect

Technicians must connect a Stripe account to receive payments. By doing so, you also agree to Stripe's Terms of Service.

5.4 Professional Standards

Technicians agree to perform all work in a professional and workmanlike manner, be truthful about their qualifications, and honor the rates and timelines they propose to customers.

6. Prohibited Conduct

You agree not to:

• Use the platform for any unlawful purpose
• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Circumvent the platform to arrange off-platform payments to avoid fees
• Impersonate any person or entity
• Introduce malware, spam, or harmful code
• Scrape or extract data from the platform without permission

7. Payments & Fees

All payments are processed securely through Stripe. True Grit Auto charges the following fees:

• Job Posting Fee: $5.00 per job post (first post is free)
• Technician Subscription: $100.00/month

All fees are non-refundable unless otherwise stated. True Grit Auto reserves the right to modify pricing with 30 days' notice.

8. Disputes Between Users

True Grit Auto facilitates connections but is not responsible for resolving disputes between Customers and Technicians. Any disputes regarding service quality, payment, or conduct must be resolved directly between the parties. True Grit Auto may, at its discretion, assist in mediation but is under no obligation to do so.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. True Grit Auto does not warrant that the platform will be uninterrupted, error-free, or that technicians will meet your expectations. We do not endorse or verify the credentials of any technician beyond what is stated on their profile.

10. Limitation of Liability

To the fullest extent permitted by law, True Grit Auto shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages for property damage, personal injury, or financial loss resulting from services arranged through the platform.

11. Termination

True Grit Auto reserves the right to suspend or terminate any account at any time for violation of these Terms, non-payment, or conduct deemed harmful to the platform or its users. You may delete your account at any time through the platform settings.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or a notice in the app. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Oregon.
